Third Appeal
If your second appeal to the city is denied, you may appeal in Santa Clara County Civil Court within 21 days of the date of denial. This court considers the factual aspects of the case, the administrative procedure, and the hearing examiner's decision. The decision of the civil court can be communicated in person or by mail.

AB503: INDIVIDUAL PAYMENT PLAN FOR PARKING VIOLATIONS
As of July 1, 2018, Assembly Bill 503 (AB 503) allows individuals in needas defined no CA Veh Code § 40220Pay unpaid parking fines and fees in monthly installments of up to twenty-five dollars ($25) for total amounts due of three hundred dollars ($300) or less. Those in need have 60 calendar days from the preparation of the violation notice or 10 days from the due process hearing, whichever comes first, to request a determination of need and request payment in installments. Unpaid parking tickets and fees are due within 18 months, with no prepayment penalty for balances paid before the payment due date. The means test must be passed before a payment arrangement can be made. AB 503 waives all late fees and penalties, except state late fees described in Government Code Sections 70372, 76000, and 76000.3 when an indigent person requests the payment plan. Waived penalties and late fees may be reinstated if the individual misses the payment schedule. The person may receive a one-time extension of 45 calendar days from the date the plan stops paying to resume payments before the city can collect them through DMV. If the City has already applied to the DMV to collect fines from a person in need, only one time if the registered owner or lessee signs a payment plan and pays a fine of not more than five ($5) dollars, the City will revoke that filing. at the DMV. The poor can request an administrative hearing without paying the parking fine, if they prove that they cannot pay the amount owed.
To qualify for a needy designation, an application must be submitted and include documentation showing that one of the following conditions is met:
(A) The individual meets the income criteria in subsection (b) of Section 68632 of the Government Code.
(B) The individual receives public benefits from any of the programs listed in subsection (a) of Section 68632 of the Government Code.
(2) A person may prove indigent by providing any of the following information, if applicable:
(A) Evidence of earnings through pay stub or other form of proof of earnings, such as review and approval by the processing entity or its designees. The processing entity or its agent must not unreasonably withhold your consent.
(B) Evidence of receipt of benefits from the programs described in paragraph (1)(B), including, but not limited to, an electronic benefit transfer card or other card, subject to review and approval by the Agent of Compensation. The processing entity or its agent must not unreasonably withhold your consent.
(3) If a defendant's need is intentionally fraudulent, your fines and fee reductions will be waived and the fines and fees will be refunded in full.

If the registered owner or renter does not enroll in the payment plan within the period specified in the notice, or is ineligible for the payment plan because they are short of cash, unpaid parking fees and fines will be paid prior to the parking violation notice expiration date.

The police department uses the trunk to immobilize vehicles with five or more parking tickets. The ability to jump start (immobilize) a vehicle instead of removing or towing it is authorized under California Vehicle Code (CVC) Section 22651.7. This allows a vehicle to be "started" up to three days before it is impounded. If the citations are not paid after three days, CVC 22651(i)(1) authorizes the police to impound the vehicle.
The owner must pay all outstanding fines to the police. Under CVC 22651(i), the owner must payNOoutstanding fines (this includes all outstanding fines, as well as fines that are listed as overdue on the record).
- The owner must also pay the current vehicle release fee.
- The only acceptable method of payment for any transaction is cash, bank check or credit card. Personal checks cannot be accepted.
The vehicle registration must be a current registration.
